China is raising its level of resource control by establishing penalty standards for violations in all processes including rare earth mining, refining, and distribution. Analysts say it has become clear that China intends to manage rare earths — a key element of global supply chains — as a national strategic asset.

According to China's state-run Global Times on the 29th, the Ministry of Industry and Information Technology released a draft of "Standard Tables for Administrative Penalties under the Rare Earth Management Regulations" (the Draft) through its website the previous day.

This Draft is a follow-up to the "Rare Earth Management Regulations" enacted last October. The Draft defines major violations as: violating quota controls during rare earth mining and refining/separation processes, refining/separation activities by unauthorized entities, and use of mineral product raw materials by rare earth comprehensive utilization companies.

Also included are: purchasing, processing, or selling products from illegal mining/refining; failure to record or report product distribution data; and refusal or obstruction of supervisory investigations.

Authorities will apply 4-tier standards based on the severity of violations: no penalty, reduced penalty, regular penalty, and aggravated penalty. Penalty measures include confiscation of illegal proceeds, related products, and equipment, along with fines; in serious cases, business license revocation is also possible — effectively a market expulsion measure.

China effectively dominates the global market in rare earth production and refining. Strongly cracking down on illegal distribution and unauthorized production is interpreted as a signal to further strengthen control over the entire supply chain.

The Ministry of Industry and Information Technology stated: "This is to strengthen implementation of the Rare Earth Management Regulations and standardize related law enforcement," adding "It is a measure to elevate the level of rule-of-law-based industry management." This is seen as meaning the state will manage every step from rare earth production to distribution in real time.

A source in Beijing who requested anonymity said: "It can also be interpreted as a measure to strengthen control over critical strategic resources and maintain influence over the entire supply chain."
